Terms of service

1. Who we are
getmentis.com is operated by Mentis Therapeutics Limited, a company registered in England and Wales (company number 13760219), registered office 35 Dean Street, London, W1D 4PR. In these terms, "we", "us" and "our" mean Mentis Therapeutics Limited.
You can reach us at hello@getmentis.com.
2. About these terms
These terms apply when you use our website or buy from us. By placing an order you agree to them, so please read them first.
Nothing in these terms removes or limits your legal rights as a consumer. If anything here conflicts with those rights, your legal rights win. If you'd like to know more about them, contact Citizens Advice on 0808 223 1133 or at citizensadvice.org.uk.
We may update these terms from time to time. The version that applies to your order is the one published when you placed it.
You must be 18 or over to buy from us.
3. What we sell — and what we don't
This matters, so we've set it out plainly.
We sell growing equipment and uncolonised substrate. That means the physical kit, the container, the tools, and sterilised growing medium that has not been colonised or inoculated with anything.
We do not sell spores, spawn, liquid cultures, colonised substrate, live mycelium, or mushrooms of any kind. We don't supply them, source them, or recommend suppliers of them. If you've bought something from us expecting any of those, we haven't sold it to you.
What you choose to introduce to the substrate after it reaches you is entirely your decision and entirely your responsibility. We have no knowledge of, no control over, and accept no responsibility for anything you add to our products, or for the results of doing so. That includes the legality of what you introduce, which is your responsibility to establish under the law that applies to you.
Our products are intended for cultivating culinary and functional mushroom species that are legal to grow where you live. You must not use our products for any unlawful purpose.
4. Growing and eating what you grow
Our guarantee and our support cover the kit and the substrate. They don't extend to identifying what grows.
- Identification is your responsibility. Never eat anything you cannot confidently identify. If you're unsure, don't eat it.
- Cook thoroughly. Most cultivated mushrooms should not be eaten raw.
- Allergies and sensitivities. People react differently to mushrooms, including common culinary species. Try a small amount first. If you have a known allergy, are pregnant, or are taking medication, speak to a doctor before eating anything you grow.
- Keep kits away from young children and pets.
None of this limits our responsibility for the products we actually supply — see section 11.
5. Placing an order
When you place an order, you're making an offer to buy. We'll send an email acknowledging it, but that acknowledgement isn't acceptance.
A contract only forms when we email to confirm your order has been dispatched. If we can't accept your order — the item's out of stock, we've spotted a pricing error, or we can't take payment — we'll tell you and refund anything you've paid.
We may limit or refuse orders where we have reasonable grounds to, for example where we suspect fraud, or where an order appears to be from a reseller rather than a customer.
6. Prices and payment
Prices are shown in pounds sterling and include VAT where it applies. Delivery costs are shown separately at checkout before you pay.
We take payment when your order is dispatched.
We try hard to price everything correctly, but errors happen. If we spot a pricing error before dispatch and the correct price is higher, we'll contact you to ask whether you want to continue at the correct price or cancel. If the error is obvious and you could reasonably have spotted it, we're not obliged to supply at the wrong price.
7. Delivery
We deliver to addresses in the United Kingdom only. Estimated delivery times are on our shipping policy page and are estimates, not guarantees.
Unless we agree otherwise, we'll deliver within 30 days of accepting your order. Your order becomes your responsibility once it's been delivered to the address you gave us.
Substrate is a living product with a limited shelf life. Please open and start your kit reasonably promptly after it arrives, and store it as the instructions describe.
8. Returns, refunds and cancellation
Covered separately in our Returns and Refunds Policy, which forms part of these terms. In summary: 30 days to request a return, on top of your statutory right to cancel within 14 days of delivery.
9. The Mentis Mushroom Guarantee
Separately from your returns rights, we offer the Mentis Mushroom Guarantee. It covers kit performance and substrate integrity on the terms set out on that page. It's offered in addition to your legal rights and doesn't replace them.
10. Using our website
You may use our site for browsing and buying. You may not:
- use it for anything unlawful, or to encourage anyone else to
- copy, resell or exploit any part of it without our written permission
- upload viruses or anything else malicious
- scrape, crawl or harvest data from it
- try to get around its security features
- harass, abuse or discriminate against anyone through it
We can suspend your access if you do any of these.
We do our best to keep the site available and accurate, but we can't promise it will always be uninterrupted or error-free, and we may change or withdraw parts of it.
11. Our responsibility to you
If we fail to comply with these terms, we're responsible for loss or damage you suffer that is a foreseeable result of that failure. We're not responsible for loss or damage that isn't foreseeable.
We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes our liability for:
- death or personal injury caused by our negligence
- fraud or fraudulent misrepresentation
- defective products under the Consumer Protection Act 1987
- breach of your legal rights in relation to the products, including that they are as described, of satisfactory quality, and fit for purpose
We supply our products for domestic and private use. If you use them for any commercial purpose, we won't be liable to you for loss of profit, loss of business, business interruption, or loss of business opportunity.
Subject to the above, our total liability to you in connection with any order is limited to the amount you paid for that order.
12. Reviews and things you send us
If you leave a review or send us photos, ideas or suggestions, you're giving us permission to use, publish and edit them for marketing and product purposes, without payment. You keep ownership of what you send.
You're responsible for what you submit. Please don't send anything that isn't yours, that's untrue, or that's offensive or unlawful. We can remove anything we consider inappropriate, though we're not obliged to monitor submissions.
Reviews we publish are genuine and from real customers. We don't write, buy or incentivise fake reviews.
13. Links and third-party services
Our site may link to other websites and use third-party tools. We don't control them and aren't responsible for their content, products or practices. If you have a problem with something a third party supplies, take it up with them.
14. Events outside our control
If something beyond our reasonable control stops us fulfilling your order — extreme weather, supply failures, industrial action and so on — we'll contact you as soon as we can and agree a new delivery date, or you can cancel for a full refund.
15. Your personal information
How we handle your personal information is set out in our Privacy Policy.
16. Complaints and disputes
If something's gone wrong, email hello@getmentis.com and we'll try to sort it out. We aim to reply within one working day.
If we can't resolve it between us, you may be able to take the matter to an alternative dispute resolution provider. We're not currently a member of an ADR scheme, but you're free to use one and we'll consider taking part. You can always go to court instead.
17. General
If any part of these terms turns out to be unenforceable, the rest still applies.
If we don't insist that you do something you're required to do, or delay in taking action, that doesn't mean we've given up the right to do so later.
We may transfer our rights and obligations under these terms to another organisation. We'll tell you if we do, and it won't affect your rights.
This contract is between you and us. Nobody else has rights to enforce it.
18. Governing law
These terms are governed by the law of England and Wales, and disputes can be brought in the English courts. If you live in Scotland or Northern Ireland, you can also bring proceedings in your own courts.
